Penalty Decision WagwEU 2020

On February 6, 2020 the Dutch Ministry of Social Affairs has published the ‘Penalty Decision WagwEU 2020’ which has entered into force on March 1, 2020. This Penalty Decision Policy contains sanctions for both the foreign service provider and the (Dutch) service recipient. Please find hereby more information on this Decision.

New notification date and the Dutch transposition of the PWD

On December 19th, 2019 the Dutch Ministry of Social Affairs has announced the notification obligation in the Netherlands will enter into force on March 1, 2020. All postings starting on or after March 1, 2020 should be notified in the online notification portal on www.postedworkers.nl

The Posted Workers Directive in the Netherlands

In June 2016 the Posted Workers Directive was partially transposed and implemented in the Netherlands (also known as the WagwEU). This to avoid social dumping and to protect worker’s right throughout the European Union. Four administrative obligations were presented for companies posting workers from EER countries and Switzerland to the Netherlands. At this moment three out of four obligations have been implemented. The fourth (the notification requirement), is live as of March 1, 2020. All postings on or after March 1, 2020 should be notified in the online notification portal.
