The Cockpit - Deloitte’s EU Digital Studio is a physical space created to inspire, demonstrate and ideate about the future. It is located at the heart of Brussels’ EU Quarter - a stone’s throw from the European Institutions. Our Cockpit’s maiden voyage was originally planned in April to coincide with the scheduled opening of the space; unfortunately due to the COVID-19 outbreak our ‘flights’ are currently grounded. This means that for now, we’ll be going digital.

Managing efficiently cross-border data transfers has become a hot topic of the “business transformation” agenda for the majority of international organisations today. The transfer of data outside of the EU territory is regarded by businesses as a “must have” in view of the plenty of advantages that result from the use of centralised and global on-line tools used for optimising data management and storage. We live in a globalised world and EU-based organisations are moving data overseas as a consequence. The Covid-19 pandemic has even accentuated this trend; tele-working, social media and on-line shops make even more urgent the need to share more data and more intensively, through virtual cross-border networks. 

In tandem, regulatory expectations about whether and how much data can move outside of the EU territory have evolved fast. Recently, the European Data Protection Board (EDPS) issued a new strategy regarding how EU institutions should organise cross-border data transfers. In parallel, legal instruments that were up to now regarded as “adequate” to secure data transfers outside of the EEA have been challenged [and brought to invalidation (Privacy Shield) or weakened (Standard Contractual Clauses)].

Our virtual flight will provide updates on the latest EU policy and regulatory developments on the topic of international data transfers, explaining why those are (also) relevant to the EU institutions. Through a “helicopter” view over the EDPS strategy, the session will discuss how translating the “to do’s” of the strategy into a practical roadmap that will help your institution control better data flows and mitigate potential regulatory and business risks. Thirdly, leveraging on examples from the private sector, Deloitte will propose the key elements on how designing a ‘Transfer Risk Assessment’ approach that can serve as a compass for prioritizing data transfers and help (you) build an effective “business plan” on the topic.
