A reduzida utilização da arbitragem por parte das empresas angolanas foi um dos temas em debate na Conferência “Desafios da arbitragem internacional em África”
LUANDA, 03 de Maio de 2019 – Apesar da sua relevância para a resolução de conflitos e do seu elevado impacto na economia, o número de arbitragens em Angola ainda é reduzido. O tema esteve em debate na Conferência “Desafios da arbitragem internacional em África”, organizada pela Deloitte e com a participação da Corte Internacional de Arbitragem da Câmara de Comércio Internacional de Arbitragem, que teve lugar no passado mês de Abril, em Luanda. No encontro foram analisados os principais desafios da arbitragem em África, bem como a relevância da perícia no contexto de uma arbitragem internacional.
“Este instrumento ainda é pouco utilizado em Angola sobretudo pelo desconhecimento no meio empresarial e pela sua associação a elevados encargos. É neste sentido que estes encontros são muito importantes para sensibilizar as empresas para as vantagens da arbitragem”, afirma Vera Pita, Associate Partner da Deloitte.
Como principais vantagens da arbitragem destacam-se: a celeridade na resolução dos casos e a competência das pessoas que decidem o litígio, face à complexidade e especificidade de alguns dos temas em análise. O facto de seguir um conjunto de regras internacionais, de permitir uma maior celeridade na resolução dos conflitos e de ter um carácter vinculativo em termos de decisão, fomenta a confiança dos parceiros externos e mitiga possíveis entraves ao seu investimento no País.
No caso de Angola, são apontados como principais desafios da arbitragem internacional a contínua formação dos operadores e dos árbitros, a necessidade de implementação de diversas alterações legislativas, e ainda um mais adequado funcionamento dos Centros de Arbitragem.
Neste contexto, têm sido levadas a cabo algumas reformulações no País, nomeadamente com a renovação de algumas leis internas, e têm sido criados meios alternativos para que a resolução de conflitos seja mais expedita. Angola conta actualmente com dois Centros de Arbitragem, o Centro de Resolução Extrajudicial de Litígios (CREL) do Ministério da Justiça de Angola, e o Centro de Arbitragem da Associação Industrial de Angola (CAAIA, lançado no início do mês de Abril).
Face à crescente complexidade dos processos, encerrando matérias em disputa para além do foro estritamente legal, como sejam temas de carácter económico ou financeiro, é cada vez mais importante recorrer a especialistas com conhecimento económico-financeiro, para garantir uma maior robustez e sustentação da génese do processo.
Vera Pita, Associate Partner da Deloitte, sustenta que “é neste contexto que o papel do perito, nomeadamente de assessores com conhecimento específico nessas matérias, permite responder a este desafio”, acrescentado que “a perícia sustenta uma abordagem independente em contexto de disputa, através de análises económicas e financeiras, em situações de resolução de litígios, incluindo em arbitragem”.
Por conseguinte, a perícia económico-financeira apresenta um conjunto de vantagens, como: a análise objetiva e transparente do tema em disputa, fornecendo uma base de entendimento comum entre as partes; o suporte à solução do litígio ou de constatação dos factos; a apresentação de conclusões sintetizadas e de leitura facilitada para os destinatários.
