The new Albanian Law “On Renewable Energy Resources

Tirana, 30 September 2013 – The Albanian Government has made in the last years several efforts to align the local energy market rules with the European legislation. 

The recent adoption of the new Law “On Renewable Energy Resources” (RES) based on the Directive 2009/28/EC represents a further important step toward this aim. 

RES sets the new Albanian policy framework for the promotion of investments in renewable energy technologies. Thus, within May 2014 the Albanian Government is required to publish the national action plan for the achievement of the targets for the overall share of energy from renewable resources in 2020, define streamlined licensing and permission procedures and establish incentive mechanisms like long term purchase agreements and feed-in tariffs. 

The legislation process will be supported by the competent Ministry of Energy (ME), the Albanian Energy Regulator (ERE) and the National Agency of Natural Resources (NANR). To enable the Albanian authorities to monitor the realization of the national action plan, the energy providers will be required to file annual production declarations with NANR. 

The non-filing of such declarations will be subject to an administrative penalty of 100,000 ALL. RES puts a special focus on the promotion of the installation of solar panel systems for hot water production in edifices, which shall become mandatory. 

The supply and import of such panel systems shall be exempt from VAT and customs duties. Deloitte will actively pursue the process of the determination of the incentive mechanisms for the promotion of investments in renewable energy technologies.
