Physician Payment Sunshine Act
On March 23, 2010, President Obama signed the Patient Protection and Affordable Care Act (H.R. 3590) (PPACA). It includes the Physician Payment Sunshine Act (section 6002) (PPSA), which requires pharmaceutical, medical device, biological, and medical supply manufacturers to report to U.S. Department of Health and Human Services (HHS) certain payments and transfers of value to physicians and teaching hospitals. The measure is based on a bill that was introduced more than two years ago by Senators Charles Grassley (R-IA) and Herb Kohl (D-WI) (Pub. L. 111−148, 124 Stat. 119, H.R. 3590, enacted March 23, 2010).
By March 31, 2013, any “applicable manufacturer” that provides a “payment or other transfer of value” to a “covered recipient” (or to any entity or individual at the request of a “covered recipient”) must report certain information to HHS regarding those payments and other transfers of value for a reporting period of calendar year 2012.
