Regulation of the Ministry of Finance on monitoring of certain excise goods – changes (Customs and Excise Duty Alert – 3/2013)

Draft amendments to the Regulation of the Ministry of Finance on destroying excise bands and alcoholic beverages

Draft amendments to the regulation on monitoring certain excise goods (Journal of Laws of 2010, No. 86, item 555 as amended) assume that the presence of an appropriate officer will no longer be required in case of destroying, cancelling and removing excise bands from wine products. Additionally, the Ministry of Finance proposes to waive the obligation to destroy beer and wine products which are no longer suitable for consumption, further processing or use only in the presence of a competent officer.
The draft amendments also assume that the taxpayer will be obliged to inform the head of the competent customs office at least 3 days before removing or destroying customs bands or alcoholic beverages. Subsequently, customs office representatives will analyse risks and decide whether their presence is required or not.
