Changes have been made in 2011 in the Customs law to put the onus of assessment on importers and exporters, by formally extending self- assessment to imports and exports. While clearances should now be quicker they should also be customs compliant so as withstand subsequent audit scrutiny.
Your Customs House Agent, who in most cases has your authority to file the customs clearance documents on your behalf, binds you with his decisions regarding classification, valuation, applicability of exemptions and also any other declarations made by him in the self-assessment process. Even an inadvertent mis-declaration which is subsequently discovered by Customs can have penal consequences.
