Large scale electronic discovery

Abstract

Assisting an organisation to provide extensive discovery of documents in a legal case.

Challenge

As part of a Commercial Court case, our clients’ legal advisors were required to carry out review and discovery on a large number of computers, without compromising privileged or non-relevant private data.

Approach

A number of Personal Computers were forensically copied (imaged) using best practice in two sites over a single night. This was performed without any disruption to normal business processes.

 

Data was forensically retrieved from three server computers, including a large e-mail server, again without disrupting normal business operations.

 

A personal computer held in an offshore subsidiary and potentially containing relevant data was imaged by Deloitte’s local IT Forensic team (Internationally Deloitte are one of the leading providers of electronic discovery services and have IT Forensics teams in most European countries).

 

Backup tapes were analysed to determine whether material of relevance might be stored on them.

Solution

All images and retrieved data was quickly searched for keywords and concepts provided to us by our client and their legal advisors. Documents identified were extracted and passed to the legal team.

 

E-mails were converted to an easily searchable format to simplify review by the legal team. This was done without compromising the metadata or the evidential validity of the data.

 

The legal team were provided with up-to-date, easy-to-use document analysis software which allowed them to review the large amounts of data retrieved quickly and efficiently.

 

Our IT forensics specialists provided technical support to the legal team throughout the entire review and production process.
