Examinership

thistleIf your company is struggling with excessive debt, but has a solid underlying business, you should consider examinership. 

Examinership is one of the most effective methods of corporate rescue available to companies in Ireland.

We can advise you if examinership is the best option for your company. If it is, we can act as Examiner and work with you to ensure a successful outcome is achieved. 

We often work closely with our Corporate Finance colleagues if new funding or investment is required.

How does examinership work?

The company applies to the High Court and, if successful, the court will appoint an Examiner and provide the company with protection from its creditors during the examinership process.

Advantages of examinership

  • Examinership gives the company breathing space to find fresh investment and put a proposal to its creditors
  • If the proposal is accepted, it is binding on all parties
  • Examinership typically involves a significant amount of the company’s debts being written off, enabling it to emerge from examinership in a much stronger financial position
  • During the examinership the company is able to continue trading and the directors remain in control throughout the process
