We advise most of the large listed real estate property companies on a wide range of mostly transaction-oriented VAT issues. We also help to minimise VAT costs and avoid the common pitfalls, such as the option to tax disapplication rules.
We typically advise on complex site assembly issues, such as section 106, social housing and incentive schemes for buyers.
Real estate funds
Making use of our European real estate network, we assist with pan-European VAT obligations. We help funds to comply with local rules, register for VAT and manage cash flow. We also assist with managing fee flows and minimising VAT on deal costs.
We assist the UK government and bidders in the VAT implications of PFI/ PPP projects, advising on financial modelling, VAT recovery issues, treatment of unitary charges, site assembly, and barter transactions.
We help with the VAT implications of operational property portfolio strategies, providing advice on sale and leasebacks, disposal of surplus properties, and outsourcing. We have a particular focus on improving VAT efficiencies for exempt occupiers.
