Simon Cuerden

Simon Cuerden Simon is based in the Manchester office, with responsibility for the firm’s forensic accounting services across the North of England. He has extensive experience of claims brought in litigation, acting for both claimants and defendants, as well as a single joint expert and in preparing reports for use in such litigation. He has given evidence in High Court and ICC arbitration proceedings. In addition, Simon has assisted clients in mediations.


Experience

  • ICC arbitration - Assessing the losses suffered as a consequence of the termination of a supply contract for minerals. This involved consideration of losses over a period of 20 years, principally into the future. The parties were based in Norway and Australia.
  • Business valuation - Investigating alleged misrepresentations and breaches of warranty and quantifying their effect on the purchase price of a road/earth moving contractor to the building industry.
  • Professional negligence - Assessing the valuation of a company specialising in the manufacture of plastic pre-form bottles. The valuation considered the impact of erroneous disclosures within a share sale agreement which were attributed to the alleged negligence of a firm of solicitors.
  • Fraud and investigations - Leading a major investigation at a FTSE100 company, consequent on a whistleblower’s allegations of accounting and regulatory impropriety.
