Deloitte comments on Culture Secretary Ben Bradshaw’s announcement

Rights holders would need a court order before punishing persistent illegal file sharers

James Alexander, Deloitte Media Partner said: "The fact that the government has retreated from the technical clamp down on persistent file sharers is no surprise. Perhaps this reflects that it was only intended as a shot across the bows by the government to deter people who think illegal downloading is an acceptable activity, as opposed to determined and technically adept criminals.

"The UK government's continued commitment to deal with piracy is positive as countries worldwide are struggling to deal with the issue within the framework of their existing legal structures. Technically and legally it is difficult to stop, and debates continue as to who should pay for the costs involved. However, we continue to support government endeavours to protect those whose livelihood depends on copyright, from talent to distributors.

"The development of the discussion between ISPs and the content owners is key as they will need to share and apportion the cost of tackling this issue. ISPs and content owners stand to gain or lose the most from this issue so cooperation and transparency is key."
