On February 25, 2010, Davie Yards Inc. filed a motion to the Superior Court of Quebec (Commercial Division) of the District of Montreal to obtain protection under the Companies’ Creditors Arrangement Act (CCAA). The order rendered the same day confirms the appointment of Samson Bélair/Deloitte & Touche Inc. as Monitor. On March 15, 2010, a motion has been granted to refer the file to the Superior Court of Quebec (Commercial Division) of the District of Quebec. On March 26, 2010, a motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until May 25, 2010. On May 25, 2010, a second motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until September 15, 2010. On September 15, 2010, a third motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until October 29, 2010. On October 29, 2010, a forth motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until January 21, 2011. On January 18, 2011, a fifth motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until February 18, 2011. On February 17, 2011, a sixth motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until March 10, 2011. On March 10, 2011, a seventh motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until April 1st, 2011. On March 31, 2011, an eight motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until May 19, 2011. On May 19, 2011, a ninth motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until July 7, 2011. On July 14, 2011, a tenth motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until July 22, 2011. On July 20, 2011, an eleventh motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until July 29, 2011. On July 29, 2011, a twelfth motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until August 5, 2011. On August 5, 2011, a thirteenth motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until  August 18, 2011. On August 18, 2011, a fourteenth motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until August 25, 2011. On August 25, 2011, a fifteenth motion has been granted prolonging the delay of the Debtor to eventually file a plan of arrangement and reorganization to its creditors until October 31, 2011. On October 4th, a plan of arrangement and reorganization was filed.  A meeting of creditors will be held on October 26, 2011, at 10am, at 1100 blvd Rene-Levesque East, in Quebec City.

The creditors' meeting was held on October 26, 2011 and the Plan of arrangement and reorganization was approved by most creditors but the Plan is still pending because of a motion to appeal issued by Ocean Hotels which was denied. On March 26, 2012, an additional delay was granted until June 27, 2012 to execute the Plan.
