Dow Corning Breast Implant Litigation Settlement - Introduction

Deloitte & Touche LLP was appointed as the Claims Administrator of the Dow Corning / British Columbia and Other Provinces Breast Implant Litigation Settlement ("Settlement"), by Order of the Supreme Court of British Columbia on April 26, 2004.

Please read the information on this Web Site carefully, as this will help you determine whether you are eligible for compensation under this Settlement.

The Notice of Approval and Effective Date of the Settlement ("Notice") provides important information regarding the Settlement. Please read this document carefully as it may affect your legal rights.

ATTENTION - NEW ITEMS

Notice #9 – March 12, 2012 Payment to Current and Ongoing Claimants (excluding Rupture Claims)

The Final payment to the Current and Ongoing Claimants (excluding Rupture claims) has been completed by the Claims Administrator.  This is the Final Distribution pursuant to the terms of the Settlement Agreement.

Notice # 8 - November 3, 2010 Payment to Ongoing Claimants

Further to our posting #7, the timing for the Court to complete its review and issue its determination on the remaining appeal(s) is currently uncertain and accordingly the timing for the Claims Administrator to complete a further distribution is unknown. As information is available we will post notice on this site. Should you have a change of address please notify the Claim Administrator.

Notice # 7 - August 5, 2010 Payment to Ongoing Claimants

The deadline for submitting documentation for all claims has passed. The Ongoing Claims deadline was June 1, 2009.

All Ongoing Claims submitted have been reviewed and the first payment to approved Ongoing Claims amounts was made in early August 2010.

Some claims that have been disallowed by the Claim Administrator have been appealed. Upon these claims being finalized, the Claims Administrator will be seeking direction from the Court to complete a further distribution to the Current and Ongoing Claimants. It is expected the appeals will be finalized by the Court in the Fall of this year.

Notice # 6 - September 6, 2007

Payment to Current & Rupture Claimants

The third and final payment to the Approved Current & Rupture Claimants was made on September 6, 2007 and was based on each Claimants approved ratio. This payment represents the third of three payments which were to be made to the Approved Current & Rupture Claimants. All Current Claimants are requested to keep the Claims Administrator advised of any change of address until the Settlement is fully administered, which will be by December 2010.

The next distribution will be for approved Ongoing Claims. All Ongoing Claims must be submitted to the Claims Facility on or before June 1, 2009.

Notice # 5 - July 31, 2006

Payment to Expedited, Raw Material and Current & Rupture Claimants

The BC Settlement Facility has now made payments to Approved Expedited, Raw Material, and Current & Rupture Claimants.

The payments to the Approved Expedited Claimants and Raw Material Claimants were one time payments and no further payments will be made to these categories of Claimants.

The second payment to the Approved Current & Rupture Claimants was made on July 27, 2006 and was based on each Claimants approved ratio. This payment represents the second of multiple payments to be made to the Approved Current & Rupture Claimants. The second payment was paid at $1,739 per ratio point.

Further payments will be made in the coming years to Approved Current and Rupture Claimants. Payments will be made following the receipt of additional funds from the Settlement Facility for the Dow Corning Trust, in accordance with the provisions of the Dow Corning/BC and Other Provinces Breast Implant Litigation Settlement Agreement.

 

Important Notice # 4 - January 19, 2006

Payment to Expedited, Current and Rupture Claimants

The BC Settlement Facility has now made payments to Approved Expedited, Current and Rupture Claimants.

The payment to the Approved Expedited Claimants is a one time payment and no further payments will be made to this category of Claimant. The payment to the Approved Current and Rupture Claimants was made on December 13, 2005 and was based on each Claimant's approved ratio. This payment represents the first of multiple payments to be made to the Approved Current and Rupture Claimants.

Further payments will be made in the coming years to Approved Current and Rupture Claimants. Payments will be made following the receipt of additional funds from the Settlement Facility for the Dow Corning Trust, in accordance with the provisions of the Dow Corning/BC and Other Provinces Breast Implant Litigation Settlement Agreement.

We note there are still some Current and Rupture Claims in the review process. Following completion of the review, these claimants will be notified of the Claims Administrator's determination. If the claims are approved, the Claimant will also be notified of their placement on the Compensation Schedule, the corresponding ratio and will subsequently be paid their pro-rata share.

 

Important Notice # 3, posted July 15, 2005

The Initial Claims Deadline has now passed. We are therefore now in the process of reviewing all the claim forms filed to determine the eligibility of claims in the Settlement and to approve compensation in accordance with the terms of the Settlement Agreement. 1,166 claims have been approved to date. Should any technical deficiencies be noted in a claim, claimants will be sent a letter from the Claims Administrator advising the nature of the deficiency and providing 45 days to rectify the deficiency. Once this process has been completed, claimants will receive a letter either approving or rejecting their claim. Payments will be made to approved eligible claimants thereafter in accordance with the terms of the Settlement Agreement. Initial payments have been made to 444 Expedited Claimants based on the date the Expedited Claim was filed and approved.

Please be advised that by Order of the Supreme Court of British, the Initial Claims Deadline has been extended to February 1, 2005. A copy of the Order can be found on the Documents page of this website at Item 12.

This Order changes the deadline for filing your Claim Form and other supporting documentation.

Please be advised that by Order of the Supreme Court of British Columbia, the Registration Deadline for participating in the BC & Other Provinces Settlement Agreement has been extended to December 1, 2004. A Copy of the Order can be found on the Documents page of this website at Item 10.
