Amendment of additional duty rates applicable on imports of certain products originating in the United States
In 2005, Regulation (EC) 673/2005 imposed a 15% ad valorem additional duty on imports of certain products from the United States due to the country’s failure to bring the Continued Dumping and Subsidy Offset Act (Byrd-Amendment) in compliance with its obligations under WTO agreements. Since the regulation came into force, Annex I to this regulation, which contains the list of products to which the additional duties are applicable, was adjusted several times.
Since the level of nullification or impairment and consequently of suspension has increased during fiscal year 2012, the European Commission has altered the additional duty rate from 6% to 26%. Furthermore, the Commission also amended the list of products in Annex I, adding “women’s or girls’ cotton denim trousers and breeches” to the list. The effect of a 26% ad valorem additional import duty on products in Annex I represents trade of no more than USD 60,774,402 over one year.
