The Federal Court of Australia has held that ‘TV Now’, a service which offers Optus 3G mobile subscribers the facility to record and play back free-to air-television (FTA) programs on various mobile devices, does not infringe the rights of those who own the underlying copyright, or rights to the television programs.
The big issue is that these subscribers are able to play back recorded programs ‘near live’ – in some cases with only a 90 second delay to the live, free-to-air broadcast. This potentially changes the value equation associated with live events to those broadcasters and media platforms that have paid for exclusive access to such live content, as well as those who have secured exclusive digital rights.
