| Advocate General favours Marks & Spencer (M&S) claim for cross-border loss relief |

The Advocate General (AG) made a recommendation today (April 7th), to the European Court of Justice (ECJ) finding in favour of the taxpayer, in a case which has been watched closely by international business and Finance Ministers across Europe. “This is a partial victory for M&S - they have won on a point of principle, but it is still not clear that they, and companies like them, will necessarily be successful in their claims,” comments Pat Cullen, Senior Tax Partner of Deloitte. “The AG opinion, if followed by the ECJ, gives room for Member States to protect their revenues. Deloitte, one of Ireland’s leading professional services firms, is backing the efforts of the Irish Cricket Team to qualify for the 2007 World Cup which will take place in the West Indies. Senior executives overwhelmingly believe that the present tax collection and payment system is too costly, complex and cumbersome, particularly for small and medium sized businesses. At the Deloitte Finance Bill Breakfast today, at which over 250 senior executives were present, over 90 percent of attendees believed that the present system of making up to five tax payments in a calendar year should be restricted to the larger tax payers. A new survey by Deloitte shows a wide divergence in remuneration levels and social security costs in 19 of the 25 EU member states. In particular, the survey highlights a wide gap in the remuneration levels of the new member states and the old original 15 members prior to the expansion of the EU last May. According to the survey, the Slovak Republic has the lowest remuneration costs at just under €6,500. Poland and Estonia are not far behind with remuneration levels of €7,125 and €7,423 respectively.
