Consultation Conclusions on SFC New Type 13 Licence for Trustees and Custodians of Hong Kong Public Funds (RA 13) 

On 23 May 2023, the Hong Kong Securities and Futures Commission (SFC) published the Consultation Conclusions on the Regulatory Regime for Depositaries of SFC-authorised Collective Investment Schemes (RA 13) and a further consultation on amendments to related subsidiary legislation and SFC codes and guidelines to implement the regulatory regime for depositaries of SFC-authorised collective Investment schemes (CISs).

The affected CISs include unit trusts, mutual fund companies, real estate investment trusts, and pooled retirement funds authorised under section 104 of the Securities and Futures Ordinance (SFO) and open-ended fund companies registered and authorised under the SFO.

On 27 July 2023, the SFC subsequently announced it has started accepting RA 13 licence and registration applications. To accommodate the new RA 13 regime, trustees and custodians need to start planning well in advance.
