Bristol-Myers, Baxter, 3M Breast Implant Litigation Settlement

Deloitte & Touche LLP was appointed as the Claims Administrator of the British Columbia Bristol-Myers, Baxter, 3M Breast Implant Litigation Settlement ("Settlement"), by Order of the Supreme Court of British Columbia dated August 5, 2005.

Important Notice # 3 – June 13, 2007
Payment to Approved Claimants

The Claims Administrator has now issued a full and final payment to all Claimants who were approved in the Bristol-Myers, Baxter, 3M Breast Implant Settlement.  The distribution was based on each Claimant’s approved compensation units which had previously been communicated.The payment to the Approved Claimants was a one time payment and no further payments will be made in this Settlement.

Important Notice #2 - November 8, 2006

The Claims Administrator has completed its review of all claims filed and at the end of August, provided written notification to the claimants of whether their claim has been approved, partially approved or rejected.  At the time of notification all claimants were provided with 30 days, pursuant to the terms of the agreement, to provide written notification to the Claims Administrator should they disagree with the acceptability of their claim.
The Claims Administrator has reviewed all appeals submitted, and has notified the appellants of whether their appeal has been successful or whether the Claims Administrator is still unable to accept the claim, or portion of the claim, as filed.  Appeals which continue to be disputed must be determined by the Court, and it is only once this process has been completed that the Claims Administrator will be in a position to issue a one time distribution to claimants.

Important Notice # 1 – February 22, 2006

The Claims Deadline has now passed and all claims have been reviewed to determine the eligibility of claims in accordance with the terms of the Settlement Agreement. Should any technical deficiencies have been noted in a claim, notice of the deficiency was sent to the claimant (or their counsel) in early February.  The letter from the Claims Administrator will have advised of the nature of the deficiency and provided 45 days to rectify the deficiency. As further updates are available they will be posted to this website.
